Improvement of the legal mechanism for regulating public education management

Abstract. Introduction. The relevance of the study of the problem of improving the legal regulation of public education management is due to a number of objective factors that reflect modern challenges and trends in the field of education and public administration, and the improvement of legal regulation in this area is carried out in order to ensure the effectiveness of educational policy, achieve the required level of quality of educational services, create conditions for sustainable development of the education system and compliance with international standards in the field of education. Purpose. The purpose of the study is to substantiate the theoretical principles of regulating public education management and determine the main ways to improve the legal mechanisms of such regulation. Materials and methods. During the study of the specified issues, theoretical methods were used, in particular, analysis and generalization of scientific research in the field of jurisprudence, public administration and pedagogy, related to a specific topic, their comparison and interpretation, as well as classification and systematization of ways to improve the legal mechanisms of public education management, proposed by representatives of various sciences and scientific forecasting of possible consequences of improving the legal mechanisms of regulating public education management. Results. It was established that the improvement of public education management is due to the need to adapt the administrative and legislative systems to changes in the educational environment and society. The common and distinctive features of the concepts of state policy and public policy are determined, taking into account the specifics of their applications in the educational sphere, attention is paid to the phenomenon of state and public education management, taking into account its legal status, enshrined in educational legislation. The main ways of improving the legal mechanisms for regulating public education management are identified, which include achieving compliance of management support with international standards and the European vector of development, improving legal mechanisms for education management, ensuring transparency and accountability in the field of public education management, taking into account the trend of decentralization, as well as the actualization of issues of inclusive education and equal access to educational services. Particular attention is paid to the issue of digitalization of public administration based on digital transformation, which is characterized by changing public administration mechanisms through innovation, modernization of education and its transition to a higher quality and modern level, ensuring optimal accessibility of education and educational programs, ensuring integration processes into the European educational and economic environment and deepening the processes of European integration and is capable of ensuring the achievement of transparency as a fundamental property of public education management. Discussion. Adaptation of the administrative and legislative systems to changes in the educational environment and society requires compliance of administrative support with international standards and the European vector of development, improvement of legal mechanisms for education management, ensuring transparency and accountability in the field of public education management, taking into account the trend of decentralization and the actualization of issues of inclusive education and equal access to educational services. Solving these problems is a necessary condition for achieving high quality education, its compliance with international standards, as well as the creation of an effective system of public management of it.
